Who Pays for Forensic Cleaning in NSW?
When a death occurs at a property and forensic cleaning is required, one of the first questions families and property managers ask is who is responsible for the cost. It is a completely reasonable question, and one that deserves a clear, honest answer.
The answer depends on what has been affected. To understand that, it helps to understand something that most people do not know.
Decomposition begins the moment a person passes away. This is an immediate biological process. There is no grace period. Even when a death is discovered within 24 hours, contamination may already be present in the immediate environment, including the mattress, bedding, and soft furnishings surrounding the person. The longer the time elapsed before discovery, the greater the risk that contamination has moved beyond contents and into the building itself.
This distinction between contents and building contamination is often what determines who pays.
When Contents Are Affected
In many cases, particularly where a death has been discovered relatively quickly, contamination is contained to the contents. This may include the mattress, bedding, clothing, carpet, or soft furnishings in the immediate area. The building itself may not be affected.
In these circumstances, the cost is typically the responsibility of the family or the deceased person's estate. Biohazardous contents cannot be placed in a general waste bin. When the Building Is Affected
When a death remains undiscovered for an extended period, contamination can move beyond the immediate area and into the building itself. Fluids can penetrate flooring, seep into subfloor areas, enter wall cavities, and affect other structural elements of the property.
Where structural contamination is identified, the property owner must be notified. This is because the owner is responsible for the condition of the building and for arranging any required remediation to affected structural areas.
At this point, insurance may become relevant. Depending on the circumstances and the terms of the policy, home insurance or landlord insurance may contribute towards the cost of structural remediation. However, insurance cover should never be assumed, and each claim is assessed by the insurer on its own merits.

When Both Are Affected
In more complex situations, both contents and structural elements may require remediation. In these cases, costs may be divided between the family or estate for contaminated contents and the property owner for building-related remediation.

What NSW Police May Cover
If NSW Police use specialist products as part of their investigation, they may cover the cost of that specific cleaning activity. The officer in charge will advise if this applies.
This does not extend to the full remediation of the property, which remains the responsibility of the relevant parties.
